Nintendo rattling its legal sabers harder than before is what's going on. This article summarizes it quite comprehensively.

Backing my rom collections up to disc just in case I have an HD fail.

Backing my rom collections up to disc just in case I have an HD fail.

That already applied before the romsite shutdowns, because in the course of time, online data can disappear and hardware can fail.
Ideally, backups should stored remotely, so that a fire or burglar can't take the original data and the backups.
